1. What this portal is

The Recalde Case Portal is an online tool offered by Recalde Law Firm, P.A. It helps you do three things: answer intake questions about a potential Florida Lemon Law or bankruptcy matter, organize and upload the documents the firm would need to evaluate that matter, and read general information about how these areas of law work. By creating a profile or using the portal in any way, you agree to these Terms of Use.

2. No legal advice

Nothing in this portal is legal advice. The intake questionnaire, the qualification results, the deadline estimates, the document checklists, and the AI assistant all provide general information only. They are starting points for a conversation with an attorney, not a substitute for one. Your situation has facts that no questionnaire can fully capture, and only a licensed attorney who has reviewed your specific circumstances can give you legal advice.

3. No attorney-client relationship until the firm accepts your case

Using this portal does not make you a client of Recalde Law Firm, P.A. Submitting an intake, uploading documents, chatting with the assistant, or receiving a qualification result does not create an attorney-client relationship. That relationship begins only when the firm affirmatively accepts your case and you both sign a written engagement agreement. Until then, do not assume the firm is protecting any deadline, filing anything, or taking any action on your behalf.

4. Your responsibilities

The portal only works if the information you put into it is true. You agree to provide accurate, complete, and current information in the intake questionnaire and in every document you upload, and to update anything that changes. Inaccurate information can lead to a wrong qualification result, a declined case, or, in a bankruptcy filing, serious legal consequences, because bankruptcy schedules are signed under penalty of perjury. You are also responsible for keeping your sign-in method secure and for everything done under your account.

5. Acceptable use

You agree not to:

  • Use the portal for any unlawful purpose or to submit information about someone else without their permission.
  • Upload malicious code, attempt to probe or breach the portal's security, or interfere with its operation.
  • Use automated tools to scrape, spam, or flood the portal, its forms, or its AI assistant.
  • Misrepresent your identity or impersonate any person or entity.
  • Resell, copy, or commercially exploit any part of the portal without written permission.

6. Intellectual property

The portal, including its design, text, graphics, logos, software, and content, belongs to Recalde Law Firm, P.A. or its licensors and is protected by copyright and trademark law. You keep ownership of the documents and information you upload. By uploading them, you give the firm permission to store, display, and use them for the purpose of evaluating and, if accepted, handling your matter.

7. Account and data deletion

You can sign out at any time from the Settings page. You can also permanently delete your data: the Settings page includes a Delete my data button that, after you confirm, wipes every piece of locally stored information, including your profile, intake answers, case records, document records, and preferences. In the current demo phase all of this data lives in your own browser, so deletion is immediate and complete on your device. In the production phase, deletion requests will also remove your data from the firm's cloud storage, except where the firm is legally or ethically required to retain records.

8. Disclaimers

The portal is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. The firm does not warrant that the portal will be uninterrupted, error-free, or secure, that qualification results are correct, or that deadline estimates are accurate. Deadline dates shown in the portal are estimates for planning only until the firm confirms them in writing after accepting your case.

9. Limitation of liability

To the fullest extent permitted by law, Recalde Law Firm, P.A. and its attorneys, employees, and service providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, opportunity, or claims, arising out of your use of or inability to use this portal. The firm's total liability for any claim relating to the portal is limited to one hundred dollars ($100). This limitation does not apply to obligations the firm assumes in a signed engagement agreement, and nothing here limits liability that cannot be limited under Florida law or the Rules Regulating The Florida Bar.

10. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising from these Terms or the portal must be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

11. Changes to these Terms

The firm may update these Terms from time to time. The Last updated date at the top of this page shows the current version. Material changes will be flagged inside the portal. Continuing to use the portal after a change takes effect means you accept the updated Terms.
